Kevin F. Cook, Partner

DIRECT 212.937.4048 FAX 212.937.4050

Kevin has a three decades-plus record representing airlines, service companies and aviation product manufacturers. He defended over 100 actions brought against a foreign state-owned airline arising out of the famous 1976 Entebbe hijacking. Appearing before the Court of Appeals of New York, Kevin obtained a dismissal of all actions pursuant to the Foreign Sovereign Immunities Act. This was the first time that a New York court relied on the FSIA in dismissing an action against an airline.

Kevin also defended consolidated actions against a U.S. helicopter manufacturer arising out of a crash of a helicopter into a crowded beach in Uruguay. Kevin obtained a dismissal of all the actions pursuant to the government contractor defense. This was the first time the defense was relied upon by a New York court in dismissing an action against an aviation product manufacturer. Kevin successfully defended this dismissal in the Appellate Division and the Court of Appeals of New York.

Kevin has handled numerous jury and non-jury negligence, product liability and insurance coverage cases, and has appeared frequently in the New York state and federal courts.

Kevin has been invited to provide legal presentations before large client gatherings as part of the firm’s claims prevention and defense services. He has contributed to Southern Methodist University Law School’s “Journal of Air Law & Commerce” and is listed in Marquis’ “Who’s Who in American Law.”
